Terms of service.

These terms govern your use of Our Date, operated by Our Date Pty Ltd. By creating an account, you agree to these terms.

The service

Our Date provides tools for you to create, host and share a wedding website. The service is offered on an “as is” basis, subject to the guarantees under the Australian Consumer Law which cannot be excluded.

Your account and content

You are responsible for the accuracy and lawfulness of the content you upload. You retain ownership of your content; you grant Our Date a limited licence to host and display it for the purpose of running the service.

Payments and refunds

The one-time fee is AU$99, GST included. If your website has not been published, you may request a full refund within 14 days of purchase. After publication, refunds are handled case-by-case in accordance with the Australian Consumer Law.

Acceptable use

You agree not to use Our Date to publish content that is unlawful, defamatory, or infringes the rights of others. We may suspend or remove content that breaches these terms.

Before we unpublish or remove a website for a content breach, we email you a notice explaining what we found and what happens next. Websites unpublished or removed because their content breaches these terms are not refundable.

Music and licensing

Every template includes a royalty-free example track that you are free to keep. If you upload your own song instead, you confirm that you own it or hold the rights and permissions needed to use it on a publicly accessible website, and you accept full responsibility for obtaining and paying for any music licence required.

Our Date does not clear, supply or pay for music rights on your behalf. You indemnify Our Date against any claim, demand, royalty, fee or penalty arising from music you upload, including claims by rights holders or collecting societies such as APRA AMCOS. Before your song is included you must tick the licensing acknowledgement in the builder; we record the date and time of that acceptance against your website as evidence of it. We may mute or remove uploaded music at any time if we receive a rights complaint, and we may suspend a website that repeatedly attracts them.

Hosting term

Your website will remain online for 12 months from publication. You may renew for AU$25 per year thereafter. If not renewed, your website will be archived and eventually deleted, with reasonable notice given by email.

Liability

To the extent permitted by law, Our Date's liability for any claim relating to the service is limited to the fees you have paid us in the preceding 12 months.

Governing law

These terms are governed by the laws of Victoria, Australia. The courts of Victoria have exclusive jurisdiction over any dispute.
